These Terms of Service (“Terms”) apply to all users of RealDoc.app (“the Service”). By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any additional guidelines, policies, or amendments that may be posted from time to time.
A. Modifications to the Terms of Service:Ka Technology LLC reserves the right to modify or revise these Terms at any time, as noted by "last updated" and 'version" at the top of the page. We will provide reasonable notice of any major changes, such as through email or a prominent notice within the Service. By continuing to use RealDoc.app after such changes, you agree to the modified Terms. It is your responsibility to periodically review the Terms to stay informed about our practices.
To access and use certain features of RealDoc.app, you must create a user account. You agree to provide accurate, current, and complete information when creating your account and to update it as necessary.
A. Account Security:You are solely responsible for maintaining the security and confidentiality of your account credentials, including your password. Any activity that occurs under your account is your responsibility. You agree to notify us immediately if you become aware of any unauthorized access or use of your account. We will not be liable for any loss or damage arising from your failure to comply with this obligation.
B. Eligibility:You represent and warrant that you are at least 18 years of age and are legally capable of entering into contracts. If you are using RealDoc.app on behalf of an organization, you represent that you have the authority to bind the organization to these Terms. You also must continue to maintain the accuracy and completeness of this information through the usage of our service.
Additionally, by developing, creating, and sharing these certificates you represent that you are a "Certified Continuing Education Provider" as described by the "Oregon Real Estate Agency". Do not use RealDoc.app if you do not meet this requirement.
RealDoc.app offers paid services, and fees are outlined in the pricing plans made available on our site or in agreements between you and Ka Technology LLC. Payments may be processed through a third-party provider such as Stripe, or through alternative methods like Venmo or check on a per-user basis. Payment obligations are non-cancelable, and fees paid are non-refundable unless otherwise stated.
A. Payment Authorization:By providing payment information, you agree to pay the fees associated with your account. You authorize Ka Technology LLC to charge your provided payment method for any agreed-upon fees, and you agree to keep your billing information current.
B. Non-Payment and Account Suspension:If we are unable to process a payment or if your account balance remains unpaid, Ka Technology LLC reserves the right to suspend or terminate your access to the Service. You are responsible for all outstanding fees incurred prior to suspension or termination.
C. Alternative Payment MethodsFor users choosing alternative payment methods, such as Venmo or check, payment must be completed prior to accessing services for the applicable period. Payment must be received and cleared before account services are activated or continued. Please contact us below for additional queries regarding setting up an alternative payment method.
RealDoc.app enables you to create PDF certificates by inputting data and uploading participant information in formats such as CSV files. This content, once uploaded, remains your responsibility.
A. License to Use Content:By uploading content to RealDoc.app, you grant Ka Technology LLC a limited, non-exclusive license to process and use the content solely for the purposes of providing and improving our Service.
B. Ownership of Generated ContentUsers are fully responsible for all data and content they upload, create, manage, or share through the Service. You may only provide content that you have the legal right to use and distribute, ensuring compliance with all relevant laws and regulations.
Software displayed on RealDoc.app is the property of Ka Technology LLC. You may use this content only as intended within the scope of the Service, including the distribution of certificates.
Any unauthorized use, including reproduction, distribution, or modification of our intellectual property, is strictly prohibited. You are strictly prohibited from using the Service for any illegal activities. Additionally, you may not use the Service to promote any goods or services deemed unlawful. This includes attempting to intercept or misuse another user's account information or engaging in any conduct that may harm the Service or its users.
C. User Responsibility for Content AccuracyYou agree to independently verify the accuracy of any certificates or documents generated using RealDoc.app. Ka Technology LLC is not responsible for verifying the accuracy of the content you upload or any documents generated by the Service.
We value your privacy. Our practices regarding data collection, use, and storage are detailed in our Privacy Policy. By using RealDoc.app, you agree to the collection, use, and sharing of your information as described in our Privacy Policy.
Your use of RealDoc.app must comply with all applicable laws and regulations, as well as these Terms. Any misuse of RealDoc.app may result in the suspension or termination of your account.
If you become aware of any activity that violates these Terms, please report it to our support team at info@ka-tch.com.
RealDoc.app is provided on an "as-is" and "as-available" basis. Ka Technology LLC does not make any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the Service will always be uninterrupted, error-free, and or free of defects. Usage of our service is acknowledgement that you are responsible for any damages that may arise from your use, and that you assume this risk.
B. Limitation of Liability:In no event shall Ka Technology LLC be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, data loss, or damages resulting from unauthorized access or use of your account, or any inaccuracy in certificates created by RealDoc.app.
C. User Verification Responsibility:You agree to verify all certificates and documents generated by RealDoc.app for accuracy. While we strive to prevent errors, you are responsible for confirming the correctness of all information in generated documents.
Ka Technology LLC reserves the right to suspend or terminate your account and access to RealDoc.app for non-payment or improper use of the Service, including any activities that violate these Terms or applicable laws.
A. Termination for Breach:Accounts may be terminated without prior notice in cases of severe violations of these Terms. For minor violations, you may receive a warning and an opportunity to remedy the issue.
B. Effect of Termination::Upon termination, your access to RealDoc.app will be immediately revoked, and all associated data may be deleted. Ka Technology LLC is not responsible for any data loss resulting from account termination.
By agreeing to these Terms, you agree to defend, indemnify, and hold harmless Ka Technology LLC, its affiliates, and their respective officers, directors, employees, agents, and others from any claims, damages, losses, liabilities, costs, or expenses arising directly or indirectly from your use of RealDoc.app, your violation of these Terms, or any applicable laws or regulations.
This indemnification obligation includes protecting Ka Technology LLC’s interests in the event of third-party claims or lawsuits that arise from actions directly associated with your use of the Service. This protection may cover litigation costs incurred in defending against such claims and resolving disputes related to your actions.
By using our Service, you also agree that you will not settle any matter without obtaining our prior written consent. Ka Technology LLC reserves the right to assume exclusive defense and control of any claims, and you agree to cooperate in the defense of any such claims.
By using RealDoc.app, you agree that any disputes arising out of or related to these Terms or the Service will be resolved exclusively through binding arbitration, rather than in court, except for matters that may be resolved in small claims court.
B. Arbitration Rules:The arbitration will be conducted by a neutral arbitrator and administered by an agreed-upon arbitration organization, such as the American Arbitration Association (AAA), under the applicable rules in effect at the time of the dispute. The arbitration will take place in Washington County, Oregon, or another mutually agreed-upon location. Judgment on the arbitration award may be entered in any court with jurisdiction.
C. Class Action Waiver:You agree to resolve disputes with Ka Technology LLC on an individual basis. You agree not to participate in class, collective, or representative actions, either as a class member or as a claimant, and to waive any right to a jury trial.
D. Opt-Out Procedure:You may opt-out of this arbitration agreement by notifying Ka Technology LLC in writing within 30 days of the date you first accepted these Terms. Send your opt-out notice to info@ka-tch.com
These Terms and any dispute arising out of them shall be governed by and construed in accordance with the laws of Oregon.
If any provision of these Terms is found to be invalid or unenforceable by a competent authority, that provision will be removed or limited to the least extent necessary, ensuring that the remaining provisions of these Terms remain fully effective and enforceable.
The failure or delay in exercising any right or remedy under these Terms shall not be deemed a waiver of that right or remedy, nor shall it prevent or limit any future exercise of any right or remedy.
